A 33-year-old man, Sibongiseni Ngubane, accused in the murder of Rustenburg businessman Ben Gumbi, will spend the holiday season and the start of the new year in jail. Ngubane was denied bail by Magistrate Tshenolo Mekgwe at the Rustenburg Magistrates Court. The magistrate expressed concerns that Ngubane, who is already out on bail for two other crimes, might commit another offense if released.
The tragic incident unfolded when Gumbi was shot by two attackers outside a coffee shop in Rustenburg’s CBD. The suspects fled in a stolen blue Volkswagen Polo, which was later found abandoned. Ngubane, who claimed he was hired as a Bolt driver, was involved in transporting individuals, including Melusi Sibiya, from Johannesburg to Rustenburg. He later switched to a different vehicle, a white Toyota Quest, for which he was paid a significant amount. Ngubane failed to explain the suspicious circumstances surrounding the change of vehicles and his hefty payment.
During the court hearing, Ngubane denied telling the investigating officer that his life was in danger, although he alleged mistreatment and assault during questioning. The courtroom, filled with tension and public interest, saw Gumbi’s family and friends expressing relief when Ngubane was denied bail. Gumbi’s niece, Nosipho Sibeko, stated that while this wouldn’t bring her uncle back, they hoped all involved in his murder would be arrested and face justice.
The murder, captured on CCTV, shocked the community, bearing resemblance to the assassination of rapper AKA. The assailants approached Gumbi while he was using his cellphone and fired multiple shots before fleeing, leaving behind a scene of shock and panic.
The case has been postponed to 9 January 2024, allowing for further investigations. Police investigations are still underway to track down three other suspects.
